Legal entities, on the contrary, are defined by the SAT
Since we began to work and we are introduced to the figure of the SAT, terms such as natural person and legal person, among many others that will haunt us in our working life, come to our ears.
As we move towards our goals and fiscal responsibilities arrive,
many of us have no idea what kind of person we are: physical or moral, and we
even have to resort to the help of friends or specialists to avoid continuing
with this doubt that we take away sleep.
And, although after several years of working these concepts tend
to become clearer, we do not always know everything they represent and we may
miss certain points that are of vital importance for our professional
development and to comply with our tax obligations. .
Therefore, we decided to investigate and present the most
important aspects that define individuals and legal entities, their main
differences and how you can know when it is time to make the change if you need
it. Don't worry about the research - here's everything you need to know.
The SAT portal defines the natural person as
" an individual who performs any economic activity
(seller, merchant, employee, professional, etc.), who has rights and obligations ." In
other words, it is everyone who works and receives earnings.
Among its most important characteristics are being able to have
dual nationality (in addition to Mexican), acquiring tax obligations when
reaching the age of majority or formally beginning to work, being identified by
a name, having a marital status and material body, among others.
To register as a natural person, only the interested person must
be registered in the SAT, in addition to not having to do additional procedures
to comply with their tax obligations (unless you want to register a emblem
before the Mexican Institute of Industrial Property). On the other hand, a
natural person may receive financing (credit or loan) according to their salary
and the personal credit history that they have created.
And what is a moral person?
Legal
entities, on the contrary, are defined by
the SAT as the “ entities recognized by law as
subjects of rights and obligations. They are usually created by a group of
people who come together for a specific purpose, such as commercial companies,
associations and civil societies "
In the case of legal entities, they can only have Mexican
nationality if they have been created under the laws of Mexico and have their
domicile in the Mexican Republic. On the other hand, these types of people
acquire tax obligations from the moment they are created, they are identified
by a company name independent of the name of those who make them up and they do
not have a marital status as they are not an individual.
